OVERVIEW

Welcome to Moonish (“we”, “us”, “our”). We operate this store and website, including all related information, content, features, tools, products and services, to provide you with a curated shopping experience (the “Services”). Moonish is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the “Terms”), together with any policies we reference (including our Privacy Policy and Refund Policy), describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. ACCESS AND ACCOUNT

You represent that you are at least the age of majority in your jurisdiction, and you consent to allow your minor dependents to use the Services on devices you own or manage. You may be asked to provide certain information (e.g., email address and payment details). You represent and warrant that the information you provide is true, current, and complete and that you have the right to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account.

2. OUR PRODUCTS (DIGITAL TEMPLATES)

Moonish sells digital products (e.g., Google Sheets templates). We make reasonable efforts to describe our products accurately, but colors/appearance may differ by device or settings. We do not warrant that any product will meet your expectations or match visual renderings exactly. Product descriptions and availability may change at any time. We may limit quantities or discontinue products at our discretion.

3. LICENSE; PERMITTED USE

Upon successful purchase, Moonish grants you a personal, non-exclusive, non-transferable, non-sublicensable license to access and use the purchased digital file(s) for your own personal or household use.

You may not share, resell, redistribute, publish, lend, gift, upload publicly, make available for download, or otherwise use the products for any commercial purpose without our prior written consent. Any unauthorized use terminates the license.

4. ORDERS

Placing an order constitutes an offer to purchase. We may accept or decline any order at our discretion. Orders are accepted once payment is processed and we confirm acceptance. Please review your order carefully; cancellations may not be possible once delivery access has begun (e.g., when we send the access link or file).

Your purchases are subject to our Refund Policy (no returns/exchanges for digital goods, subject to limited exceptions).

You represent and warrant that your purchases are for personal use only, not for resale or export.

5. PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price charged is the price in effect at the time of order and will appear in your confirmation email. Unless stated otherwise, prices exclude taxes and any applicable fees.

You agree to provide current, complete, and accurate purchase and payment information and to promptly update it as needed. By submitting payment information, you represent and warrant that you are authorized to use the payment method, and you agree to pay all charges incurred at posted prices, including applicable taxes.

6. DELIVERY (DIGITAL ONLY)

All products are delivered digitally. After purchase, we will deliver access (e.g., a link or file) to the email address provided at checkout, typically within 8 hours. Delivery times are estimates and may be affected by email filters or service issues.

  • You are responsible for providing a correct, accessible email address and checking spam/junk folders.

  • If you do not receive your product within 8 hours, contact us at moonish.str@gmail.com and we will resend access.

  • No title or risk of loss for physical goods applies, as we do not ship physical items.

7. INTELLECTUAL PROPERTY

The Services and all content (including trademarks, logos, text, graphics, images, video, audio, and their selection/arrangement) are owned by Moonish or its licensors and are protected by applicable intellectual property laws. Except for the limited license in Section 3, no rights are granted to you. You may not copy, modify, create derivative works, distribute, publicly display, or otherwise use our content without prior written consent.

Moonish names, logos, and related marks are trademarks of Moonish. Shopify names and marks are trademarks of Shopify. All other marks are the property of their respective owners.

8. OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available,” without warranties or endorsements. Your use is at your own risk and subject to the third party’s terms. Future features and tools will also be subject to these Terms.

9. THIRD-PARTY LINKS

The Services may contain links or materials from third parties. We do not control or endorse third-party content and are not responsible for any damages arising from your use of third-party sites or services. Review their policies before engaging in transactions with them.

10. RELATIONSHIP WITH SHOPIFY

Moonish is powered by Shopify. However, all sales are made directly between you and Moonish. Shopify is not responsible for your purchases from Moonish. You expressly release Shopify and its affiliates from claims arising from your transactions with Moonish.

11. PRIVACY

Our collection and use of personal information are described in our Privacy Policy. Because the Services are hosted by Shopify, certain data processing is performed by Shopify in accordance with its privacy policy. By using the Services, you acknowledge both policies.

12. FEEDBACK

If you submit ideas, suggestions, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display the Feedback for any purpose. You represent that you own or control the rights to your Feedback and that it complies with these Terms. We may remove Feedback at our discretion.

13. ERRORS, INACCURACIES, OMISSIONS

Information on the Services may contain errors or omissions (including in descriptions, pricing, or availability). We may correct any errors and update or cancel orders if information is inaccurate, at any time without notice.

14. PROHIBITED USES

You may use the Services only for lawful purposes. You may not, among other things, (i) violate laws; (ii) infringe IP or privacy rights; (iii) harass or harm others; (iv) transmit malware or spam; (v) scrape, crawl, or collect others’ data; (vi) circumvent security; or (vii) copy, resell, or exploit the Services. We may suspend or terminate access for violations.

15. TERMINATION

We may suspend or terminate your access to the Services at any time, with or without notice. Sections intended to survive termination (including Intellectual Property, License/Use restrictions, Feedback, Disclaimers, Limitation of Liability, Indemnification, Severability, Waiver/Entire Agreement, Assignment, Governing Law, and Privacy) will survive.

16. DISCLAIMER OF WARRANTIES

The Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted, timely, secure, or error-free use. Some jurisdictions do not allow certain disclaimers; in those places, the disclaimer applies to the fullest extent permitted by law.

17. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Moonish and its affiliates, officers, employees, agents, contractors, service providers, and licensors (and Shopify and its affiliates) shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services or products, even if advised of the possibility. Our total liability for any claim will not exceed the amount you paid for the applicable product.

18. INDEMNIFICATION

You agree to indemnify and hold harmless Moonish, Shopify, and their affiliates, officers, employees, agents, contractors, licensors, and service providers from claims, losses, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your violation of law or third-party rights, or your use of the Services.

19. SEVERABILITY

If any provision of these Terms is unlawful or unenforceable, it will be enforced to the maximum extent permitted, and the remainder will continue in full force and effect.

20. WAIVER; ENTIRE AGREEMENT

Our failure to enforce any right is not a waiver. These Terms, together with the policies referenced herein, are the entire agreement between you and Moonish and supersede prior agreements. Any ambiguities will not be construed against the drafting party.

21. ASSIGNMENT

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without notice.

22. GOVERNING LAW

These Terms and any related disputes are governed by the laws and courts of the jurisdiction where Moonish is headquartered, which shall have exclusive jurisdiction and venue.

23. CHANGES TO TERMS

We may update these Terms from time to time. We will post the revised Terms and, where required by law, provide notice of material changes. Your continued use of the Services after changes become effective constitutes acceptance.
